Attention: Landlords – NYC’s Local Law 1 – Lead Paint

Northfield Community LDC is reaching out to property owners to let them know about NYC’s Local Law 1.
Lead is a harmful metal that can poison people, especially children, when it is ingested. In young children, lead can cause behavioral and learning problems that cannot be cured. Although there are other sources of lead poisoning, lead is often found in paint (it was used to make the paint stronger) used in apartments and residential buildings in New York City built before 1960.

Here are a few key points about the law:
Local Law 1 of 2004 is a New York City law that aims to prevent childhood lead poisoning by addressing lead paint hazards in housing.
The law applies to:
  • Residential buildings
    The law applies to one- and two-unit buildings that are tenant-occupied.
  • Building built before 1960
    The law assumes that lead-based paint may exist in buildings built before 1960 that have rental apartments and a child resident.
The law requires
Landlords to:
  • Inspect apartments for lead paint hazards annually
  • Use safe work practices and trained workers
  • Repair lead paint hazards before a new tenant moves in
  • Keep records of all notices, inspections, and repairs
  • Make bare floors, windowsills, and window wells smooth and cleanable
  • Provide annual notice and investigation records for lead-based paint hazard violations
New York City Department of Housing Preservation and Development (HPD) to:
  • Respond to complaints about peeling paint
  • Issue violations for lead-based paint hazards
  • Repair lead-based paint hazards when the property owner does not comply
  • Audit property owner compliance
